Judgment
Heard Mrs. B.L. Kanka Valli, learned counsel for the petitioner and Mrs. N.V.R. Rajyalaxmi, learned standing counsel for Central Government, representing Mr. N. Bhujanga Rao, learned Deputy Solicitor General of India, appearing for respondent Nos.1 and 2.
Learned standing counsel for respondent Nos.1 and 2 submitted that in the light of judgments of this Court in W.A. No.194 of 2026 dated 17.02.2026 and W.A. No.128 of 2026 dated 05.02.2026, the petitioner is required to approach concerned Court seeking No Objection Certificate (NOC) for renewal of passport and based on which the concerned passport officer would consider the application of the petitioner for renewal of passport.
Learned counsel for the petitioner submitted that petitioner may be given liberty to approach the learned Additional Junior Civil Judge-cum-IX Addl. Judicial Magistrate of First Class, Ranga Reddy District, ('trial Court'), by filing appropriate application seeking NOC, where case in C.C. No.9479 of 2022 is pending.
In view of the above, the writ petition is disposed of, directing the petitioner to approach trial Court by filing appropriate application in C.C. No.9479 of 2022 seeking NOC for renewal of passport. As and when such application is filed, the trial Court is directed to dispose of the same, within a period of one (1) week thereof, by issuing notice to respondent No.3 - de facto complainant, by affording opportunity of hearing to them. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
