Heard learned counsel for the parties.
The instant application has been preferred by the petitioner for grant of regular bail for the offence registered under Section 498A, 323 of the Indian Penal Code and Section 3/4 of D.P. Act.
Learned counsel for the petitioner submits that provisional bail was granted to this petitioner vide order dated 19.07.2023 and pursuant to that a mediation was held and a report has been received indicating therein that the petitioner as well as the O.P. No.2 has compromised the matter before the learned Member Secretary, JHALSA, Ranchi by which terms of compromise has been incorporated. Learned counsel for the petitioner further submits that the provisional bail may be made absolute at the moment he shall pay Rs. 65,000/- as clause 4 (i) of the terms of compromise.
Learned counsel for the O.P. No.2 does not have any objection.
Having regard to the facts of the case coupled with the mediation report and terms of compromise, the provisional bail granted vide order dated 19.07.2023 is hereby made absolute subject to the condition that the petitioner shall pay Rs.65,000/- as per clause 4 (i) of the terms of compromise annexed with the mediation report. It is made clear that aforesaid amount of Rs.65,000/- shall be paid on or before 24.11.2023. Accordingly, the instant application stands disposed of.
