Hon’ble Mr. R. N. Singh, Member (J):

The present Contempt Petition has been filed by the petitioner alleging wilful defiance of the directions of this Tribunal passed in Order/Judgment dated 01.10.2020 in the aforesaid OA. The operative directions of the said Order/Judgment reads as under:-

“5.

In view of the aforesaid, without going into the merit of the claim for the applicant, we hereby dispose of the present OA with direction to the respondent no.3 to consider the applicant’s aforesaid representations and to dispose of the same by passing an appropriate reasoned and speaking order as expeditiously as possible and in any case within 8 weeks of receipt of a certified copy of this order.

The OA is disposed of in the aforesaid terms. Pending MA also stands disposed of. No costs.”

Pursuant to the notice from this Tribunal respondents have filed compliance affidavit enclosing therewith the Order dated 08.12.2020 (Annexure R-1). In the said order dated 08.12.2020, the respondents have referred to their earlier decision dated 22.10.2020.

We have heard the learned counsels for the parties.

We are of the considered view that substantial compliance/directions of this Tribunal is there by the respondents. However, learned counsel for the petitioner submits that the respondents have not supplied a copy of the Order dated 22.10.2020 referred to in the aforesaid compliance affidavit dated 08.12.2020.

In view of the aforesaid facts and circumstances, Shri V.S. R. Krishna, learned counsel for respondents submits that a copy of the aforesaid Order dated 22.10.2020 shall be supplied to the petitioner and/or to his father within two weeks.

In view of the aforesaid, the present CP is closed. Notice is discharged. However, the petitioner shall be at liberty to avail the legal remedies in accordance with law, if so advised.
