Judgment
Heard learned counsel for the petitioner and Mr. G. Madhusudhan Reddy, learned standing counsel for respondents No.2 and 3.
Learned counsel for the petitioner submitted that show cause notice dated 30.07.2026, impugned in this writ petition was served on the petitioner on 05.08.2026 and petitioner is directed to change usage of building from residential to commercial within seven (7) days. The petitioner apprehends that coercive steps will be taken and the respondent authorities may also demolish the property of the petitioner. It is submitted that intentionally notice dated 30.07.2026 was served on 05.08.2026, as a result of which the petitioner is not in a position to submit effective reply and take steps for conversion of usage of the building from residential to commercial.
As it is stated by the learned counsel for the petitioner that show cause notice, though dated 30.07.2026, was served on the petitioner on 05.08.2026, the writ petition is disposed of with a direction to the petitioner to submit explanation to the show cause notice with a period of seven (7) days from today. The petitioner is also directed to make appropriate application for conversion of the subject building from residential to commercial. In case petitioner submits explanation, the same shall be considered and order shall be passed by the respondent No.3 in accordance with law. Until such exercise is completed, no coercive steps shall be taken against the petitioner in respect of show cause notice No.612/TPS/ Cir.No.53/CMC/2026 dated 30.07.2026.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
