Kamal Singh vs Haryana State Pollution Control Board & Ors

In this Original Application, the plea of the applicant is that Respondent No. 2 is running a Multispecialty Hospital in Sector 16, Faridabad. Initially, the Consent to Establish (CTE) was granted to the Respondent No. 2 but in the meanwhile, Respondent No. 2 has extended the hospital after getting 4 acres of land from Haryana Urban Development Authority (HUDA) for cancer patients. The plea of the applicant is that Respondent No. 2 had filed an application for CTE before the Haryana State Pollution Control Board (HSPCB) which was declined by order dated 19.05.2021. Yet, Respondent No. 2 is running the cancer unit in the extended area without the CTE and CTO.

Submission of the learned Counsel appearing for the applicant is that though the complaint was made to the competent authority in this regard but no action has been taken.

Having regard to the grievance raised in the application, we are of the view that the said grievance, at the first instance, needs to be considered by the Member Secretary, HSPCB.

Hence, we dispose of the present OA directing the Member Secretary, HSPCB to consider the above grievance of the applicant and take necessary remedial action, is required, expeditiously by following due process of law.

The OA is accordingly disposed of.
