Judgment
M. Jaichandren, J.—This Habeas Corpus Petition has been filed by the petitioner praying that this Court may be pleased to direct the respondents 1 and 2 to produce the detenu, Manivannan, the husband of the petitioner, aged about 35 years, and to set him at liberty.
There is no representation on behalf of the petitioner.
As directed by this Court, a Status Report, dated 25.07.2011, had been filed by the second respondent. In the said Status Report, it has been stated that the respondents 3 to 7 are the step brothers and sisters of the detenu and they are living at Chinnalapatti Village. The detenu had been brought up by one Ramasamy Chettiar, the father of the respondents 3 to 7. The said Ramasamy Chettiar had expired on 04.03.2011. However, the detenu did not attend his funeral. Thereafter, there was no cordial relationship between the detenu and the respondents 3 to 7.
It had been further stated that the detenu was addicted to drinking, and therefore, he had a number of disputes with the members of his family, including the petitioner herein. In such circumstances, the detenu had left the petitioner and had gone away on his own volition.
It had also been stated that, after submitting the complaint, dated 11.05.2011, before the Superintendent of Police, Dindigul District, the petitioner had not appeared before the second respondent, for further investigation, in spite of several requests to do so.
In view of the above, this Court finds that no further orders are necessary in the present Habeas Corpus Petition, at this stage. Hence, the Habeas Corpus Petition stands closed. However, it is made clear that it would be open to the second respondent to continue with the investigation, based the complaint lodged by the petitioner, and to take appropriate steps, as per law.
