Heard Mr. S. Sridhar, learned counsel for the petitioners, and Mr. K. Ravi Mahender, learned standing counsel for the Cyberabad Municipal Corporation (CMC), appearing for respondent Nos.2 to 4.

The impugned shortfall letter dated 28.06.2026 has been issued to the petitioners pursuant to their application seeking permission for construction of residential building comprising of stilt + 3 upper floors in the land admeasuring 300 square yards in Survey No.41/11 bearing H.No.1-92/1/24/1/3/A of Khanamet Village, Serilingampally Mandal, Ranga Reddy District.

Learned counsel for the petitioners submitted that in similar circumstances, this Court disposed of W.P. No.10352 of 2021 by order dated 26.10.2022.

Learned standing counsel for CMC submitted that there are four (4) objections taken in the impugned shortfall letter. So far as, objection No.4 is concerned, same is covered by the order of this Court in the above writ petition. Assuming that objection No.4 cannot be maintained in the light of judgment in the aforesaid case, petitioners are required to comply with objection Nos.1 to 3. In response, learned counsel for the petitioners submitted that shortfall letter objection Nos.1 to 3 will be duly complied with.

In the said circumstances, following the order dated 26.10.2022 in W.P. No.10352 of 2021 and subsequent order dated 08.09.2023 in W.P. No.24978 of 2023 and order dated 24.06.2024 in W.P. No.15747 of 2024, this writ petition is disposed of with a direction to the respondents Nos.3 and 4 to consider the building permission application of the petitioners in respect of the subject property without reference to the shortfall objection and pass orders, in accordance with law, within a period of twenty one (21) days from the date of compliance of the shortfall objection. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
