Judgment
In respect of the Respondent No.1 notice was not delivered and the report indicates that it was received back at Lodhi Road. As such, service of notice to Respondent No.1 is incomplete. Hence, this tribunal in the interest of justice directs the Appellant to file requisites together with process fee within three days from today and in that, the office of the Registry shall issue notice to Respondent No.1 through speed post with proper and correct address.
In the meanwhile, the Learned Counsel for the Respondent No.2 is directed to file his Reply/ Response/Counter before the office of the Registry not only through e-filing but also in the form of hard copy and the copy of the same shall be exchanged between them well in advance before the next date of Hearing. On receipt of Reply/ Response/Counter of the Respondent No.2, it isopen to the Learned Counsel for the Appellant to file Rejoinder, if any, one week thereafter.
The office of the Registry is directed to list the matter on 05th January, 2022.
