Learned Counsel for the Appellant is present.
Nobody appears on behalf of the Respondents.
In terms of the Order dated 23.08.2021, Learned Counsel for the Appellant has filed Photo Stat copy of the Order dated 10.08.2021 passed by Hon'ble NCLT, Jaipur Bench in CP. No. 34/241-242/JPR/2018 on 04.10.2021, Whereby, the Order revels as hereunder: -
'At the request of the learned counsel for the petitioner as he is hospitalised, list the matter on 02.11.2021.'

Further, Order dated 23.08.2021 reveals that Learned Counsel for the Appellant was directed to take fresh steps of issuance of Notice on Respondent No. 1 to 8. However, from perusal of the Order Note dated 01.10.2021 reveals that Notices were delivered to Respondent Nos. 2, 3, 4 & 9 and Notices on Respondent Nos. 1, 5, 6, 7, & 8 were not delivered as received back.
Learned Counsel for the Appellant submits that a Service Affidavit has been filed on 21.09.2021 and Copy of the Speed Post receipt and Tracking report is annexed and marked as Annexure A1, which is taken on record.
Learned Counsel for the Appellant is directed to take steps for sending substitutive service of Notice on the remaining Respondents and file a Hard Copy of a proper application before this Tribunal, within one week after Durga Pooja Vacation. Office of the Registry is directed to accept the same.
