Jasgun vs Utkarsh Gupta

Grievance in this application is against discharge of hazardous chemical wastes (Cyanide, Chromium, etc) into sewer at Udyog Kendra 2, Ecotech III, Greater Noida, UP. Vide order dated 24.08.2021 a joint Committee of CPCB and State PCB was directed to ascertain facts and furnish a factual and action taken report in the matter.

Accordingly, report has been filed on 21.10.2021 to the effect that inspection was conducted and alleged violations were not found. The observation and conclusion are as follows:-

"Observations:

The unit, M/s Swastik Metal Components, Plot No. 153, Udyog Kendra-2, Ecotech- 3, Greater Noida, Uttar Pradesh was found operational during visit.

The industry was found to be producing pen clip by pressing/forming machining process using Stainless Steel strip of 0.5 mm as raw material. The raw material is purchased from M/s Hisar Metal Industries Ltd. Copy of 3 month invoice of raw material purchase is attached at Annexure-1.

During inspection, a total of 07 press/forming machines, 01 lathe machine, 01 milling and 01 drill machine was found installed in the premises. Total 15 manpower including labor were found working in the industry.

No electroplating work was observed on the day of visit and no plant machinery was found installed for cyanide, chrome or any other type of plating in the said industry premises. The photographs activities of the unit, are attached at Annexure-2.

There was no use or generation of waste water was observed in the said industry premises other than domestic process. A bore well was found installed and it was intimated that it is used to meet the water requirements for domestic purposes. Electromagnetic flow meter was also not installed, and log book for ground water abstraction is not maintained.

The domestic effluent from the industry is discharged through the Greater Noida Industrial Development Authority sewer line.

No other type of air polluting equipment/plant was found installed in the said industry premises except one DG set of 62.5 KVA.

In the process small quantity scrap is generated (approx. 5% of raw material i.e. approx. 4- 5 Kg per day scrap) which is sold to dealers once in a month.

Unit is neither registered with U.P. State Pollution Control (UPPCB) under white category nor any intimation to UPPCB was found.

As per of Central Pollution Control Board categorization of Industrial Sectors, (S.N.14) `Engineering and fabrication units (dry process without any heat treatment/metal surface finishing operations/painting)" falls under "White Category" Copy of Central Pollution Control Board (CPCB) categorization of Industrial Sectors under Red, Orange, Green and White Category is annexed at Annexure-3. White category of industries pertains to those industrial sectors which are practically non-polluting and are exempted from obtaining the Consent to Operate" .As per categorization of CPCB "there shall be no necessity of obtaining the Consent to Operate for White category of industries. An intimation to concerned SPCB/PCC shall suffice."

UPPCB was in receipt of a complaint on 27.10.2020 through different names and e-mails and to verify the complaint, inspection of the industry was done on 28.10.2020, and was found that during the said inspection, no electroplating work was found to be taking place in the industry. A copy of the previous report is attached at Annexure-4.

Conclusion

Unit is not registered with U.P. State Pollution Control under white category and no acknowledgement in this regard was found. Hence the Unit is required to be registered with UPPCB under white category and shall intimate to UPPCB about the activities being performed with all details about raw materials, manufacturing process, water consumption, solid waste generation etc.

Though as such there is no uses of water in process and no process waste water generation, however unit needs to continue same activity and shall not change its process without prior intimation to UPPCB.

Scrap of raw material i.e. stainless steel is generated (approx. 4-5 kg/day), which is stored in the premises and sold to dealers once in a month. Log book for scrap generation and disposal shall be maintained by the unit. Unit shall not handle any toxic/hazardous chemicals within the premises without prior intimation to UPPCB.

Scrap was found lying on the floor with spillages of water from roof top and bore well in scrap storage area. Leakages need be repaired to avoid any spillages in scrap storage area.

As per Uttar Pradesh Ground Water (Management and Regulation) Act, 2019, all MSME units having water consumption less than 10 KLD are exempted to obtain No Objection Certificate from the State Ground Water Department. However the unit is required to register its bore well as per mandate of Ground Water Act and shall install electromagnetic flow meter and maintain logbook for water consumption."

In view of the above, no further order appears to be necessary. The application is disposed of.
