Mr. A.K. Bishnoi, M(A): Heard the applicant, who argued the case in person. Issue notice. Ms. Avani Kaushal, appearing as proxy counsel for Ms. Esha Mazumdar, learned counsel for the respondents, accepts notice on advance service.

The applicant in the present case is working as an Assistant Public Prosecutor in the Directorate of Prosecution, Government of NCT of Delhi. He joined the service on 04.07.2016. His claim is that after four years of service, he was entitled for the grant of Non Functional Grade of Pay Band III + Grade Pay of Rs. 5400/- w.e.f. 04.07.2020. The applicant submits that the same has been granted to other officers of his batch but has been denied to him. In this connection, he has moved a representation dated 06.07.2020 which is still pending consideration of the respondents.

The applicant submits that he would be satisfied if the respondents are directed to decide his representation in a time bound manner.

Looking at the facts and circumstances of the case, I feel that the ends of justice would be met if, at the admission stage itself, without going into the merits of the issue, the OA is disposed of with the direction to the respondents to consider the representation of the applicant dated 06.07.2020 and to decide it in a time bound manner through a reasoned and speaking order.

The OA is accordingly disposed of,with the direction to the respondents to consider the representation of the applicant as mentioned above and dispose it through a reasoned and speaking order within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that I have not made any observation on the merits of the issue.

There shall be no order as to costs.
