Heard the applicant, who arguedd the case in person.
Issue notice. Ms. Avani Kaushhal, appearing as proxy counsel for Mss. Esha Mazumdar, learned counnsel for the respondents, accepts notice on advance service.
The applicant in the present case is working as an Assistant Public Prosecutor in the Directorate of Prosecution, Government of NCT of Delhi. He joined the service on 04.07.2016. His claim is that after four years of service, he was entitled for the grant of Non Functional Grade of Pay Band III + Grade Pay of Rs. 5400/- w.e.f. 04.07.2020. The applicant submits that the same has been granted to other officers of his batch but has been denied to him. In this connecction, he has moved a representation dated 06.07.2020 which is still peending consideration of the respoondents.
The applicant submits that he would be satisfied if the responndents are directed to decide his representation in a time bound manneer.
Looking at the facts and circummstances of the case, I feel that the ennds of justice would be met if, at the admission stage itself,, withouut going into the merits of the isssue, the OA is disposed of with the dirrection to the respondents to consider the representation of the applicant dated 06.07.2020 and to decide it in a time bound manner through a reasoned and speaking orderr.
The OA is accordingly disposed of,with the direction to the responndents to consider the repressentation of the applicant as mentiooned above and dispose it through a reasoned and speaking order within a period of eight weeks frrom the date of receipt of a copy of this order. It is made clear that I haave not made any observation on the meerits of the issue.
There shall be no order as to cossts.
