Heard learned counsel for the applicant.
Sh. U. Srivastava, learned counsel for the applicant submits that the applicant was removed from service in pursuance of a disciplinary proceeding initiated against him on 03.06.2013. He submits that the respondents were duty bound to release the GPF amount to the applicant within a reasonable period thereafter. However, they have released such payment only in August, 2018. He submits that in view of the fact that the respondents have retained the money under GPF head of the applicant, all along for five years, it was incumbent upon the respondents to make payment of interest thereon such amount. For such claim, the applicant is stated to have made representation on 07.06.2019 (Annexure A/1) which is stated to be lying pending with the respondents.
Issue notice. Learned counsel Ms. Esha Mazumdar appearing for the respondents on advance service, accepts notice.
Sh. U. Srivastava, learned counsel for the applicant, submits that the OA may be disposed of with direction to the respondents to consider the applicant's aforesaid pending representation and to dispose of the same in a time bound manner.
In the facts and circumstances, we are of the considered view that if such a request of the learned counsel for the applicant is acceded to at this stage, no prejudice is likely to be caused to the respondents.
In view of the aforesaid, without going into the merit of the claim of the applicant, the present OA is disposed of with direction to the respondents to consider the applicant's aforesaid pending representation dated 07.06.2019 (Annexure A/1)and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within eight weeks from the date of receipt of a copy of this order.
The OA is disposed of in aforesaid terms.
No costs.
