Hon’ble Dr. Anand S Khati, Member (A):):-

In the present Original Application, filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:

“a. To direct the respondents to release the final GPF (GPF A/C No- DGA/09441) of the applicant immediately on urgent basis alongwith interest on delay payment.

b. Pass any other order which this Hon'ble Tribunal may deem fit and proper in the interest of justice may be awarded to the applicant and against the respondents.”

The applicant initially joined the Delhi Energy Development Agency (DEDA) as a Chowkidar on daily wages and was regularized in service on 19.06.1993. Upon being declared surplus on 05.10.2004, consequent to the winding up of DEDA, he was redeployed by the Services Department, Government of NCT of Delhi, and ultimately joined the NCC Department on 17.11.2006. The applicant was allotted a GPF account by the Principal Accounts Office, Government of NCT of Delhi, on 27.03.2009, and GPF subscriptions were thereafter regularly deducted from his salary. However, vide Office Order dated 20.10.2023, the respondents converted his GPF account to an NPS account. Aggrieved thereby, the applicant filed O.A. No. 3557/2023 before this Tribunal, wherein status quo was directed to be maintained vide order dated 19.11.2023. The applicant retired from service on 31.07.2025. Though his gratuity and leave encashment were subsequently released, his accumulated GPF amount has not been paid. Learned counsel for the respondents further submits that the applications of the applicant dated 08.07.2025 and 27.04.2026 seeking final withdrawal of the GPF amount remained unaddressed.

It is further submitted that the applicant submitted a representation dated 28.07.2026 (Annex. A1) seeking release of the GPF amount. However, the same is still pending and the amount has not been released, leading to the filing of the present O.A. He submitted that the applicant would be satisfied if a direction is issued to the respondents to consider and dispose of the said representation by passing a reasoned and speaking order within a stipulated time frame.

l4.Issue notice. Mr. H A Khan, learned counsel, appears and accepts notice on behalf of the respondents. He seeks some time to obtain appropriate instructions.

In view of the limited prayer made by learned counsel for the applicant, and without expressing any opinion on the merits of the case, the present O.A. is disposed of with a direction to the respondents to consider and decide the representation of the applicant dated 28.07.2026 (Annexure A1) by passing a reasoned and speaking order, strictly in accordance with law, within a period of four weeks’ from the date of receipt of a certified copy of this order.

The O.A. stands disposed of in the aforesaid terms, without entering into the merits of the case, at the admission stage itself. Pending M.A(s), if any, shall also stand disposed of accordingly. There shall be no order as to costs.
