This original application is registered on the basis of the news item published in Dainik Bhaskar dated 08.09.2023 titled “Unbridled illegal mining next to officers”. The news item discloses that there is large scale of illegal mining using heavy machines in progress in Jatiyana Hill just next to the Alwar District Headquarter in violation of MoEF notification dated 07.05.1992, restricting certain activities in specified area of Aravalli Range.

The news item further discloses that earlier steps were taken by the administration, therefore, mining used to be carried out during night but now, even during the day time openly illegal mining is being done in collusion with the local administration.

The news item discloses a serious issue of illegal mining in the concerned area.

Ms. Prachi Misra, Learned Counsel appearing for the Secretary, Department of Mines and Geology, Rajasthan has sought time to file the report.

At this stage, we deem it proper to implead the following authorities as respondents in the O.A.:-

(i) Secretary, Department of Mines and Geology, Rajasthan;

(ii) Regional Officer, MoEF&CC office at Jaipur;

(iii) Secretary, Central Pollution Control Board;

(iv) Secretary, Rajasthan Pollution Control Board;

(v) District Magistrate, District Alwar.

Registry is directed to prepare memo of parties and serve notice upon respondent nos. 2 to 5.

Since, the matter relates to Central Zonal Bench of the Tribunal, therefore, it is directed to be listed before the said Bench.

The above respondents are directed to file their report/reply within four weeks before the concerned Bench.

9.

The Original Application is disposed of accordingly for re-registration before the concerned Bench.
