Judgment
Per: Dr. Lata Baswaraj Patne, Judicial Member.
This matter is taken up by the Single Bench for disposal in accordance with the order of the Hon’ble Chairman, CAT dated 10/09/2021 issued under Sub-Section (6) of Section 5 of the Administrative Tribunals Act, 1985, and since no complicated question of law is involved.
The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-
“a. An order be passed directing the respondent authorities to accept the resignation letter submitted by the applicant and released him from the present place of posting forthwith.
b. An order be passed directing the respondent authority to pay the salary of the applicant as well as the remuneration of the combined duty which is lying with the concerned authority till the date.
c. Any other order or orders, direction or directions as Your Lordships may deem fit and proper”.
Ld. Counsel for both sides are present and heard.
Ld. Counsel for the applicant undertakes to file the affidavit of service before the Registry during the course of the day.
Mr. P. Prasad, Ld. Counsel appears on behalf of the respondents. He undertakes to file the memo of appearance before the Registry during the course of the day.
When the matter was taken up for admission, Ld. Counsel for the applicant submitted that the applicant was working in a Department as a GDS who had subsequently applied for the post of BPM and he was selected too. However, he had not been released to report at new post. Therefore, the applicant had submitted his resignation on 11.03.2026 and till date, neither his resignation was accepted, nor the applicant had been relieved in order to enable him to join the selected post.
Ld. Counsel for the respondents submitted that the applicant’s resignation was under scrutiny. However, it has been noticed that the applicant had submitted some false documents.
Ms. Jyotsna Mallick and Mr. Gautam Dey appears on behalf of the Department of Post and contend that noticing the said facts of submission of false documents, the request of the applicant for resignation is still under consideration. Till date, no order has been passed.
Ld. Counsel for the applicant submitted that if a direction has been issued to the respondents to consider his request of resignation and allow him to join at selected post for the post of BPM within a stipulated time, the purpose of filing of the Original Application would be fulfilled.
In view of the submissions made by Ld. Counsel for both the parties and without going into the merits of the case with limited relief, the respondents are directed to consider the resignation request dated 11.03.2026 and to pass a reasoned and speaking order in accordance with law within a period of 02 months.
With these directions, the Original Application is disposed of at admission stage without any order as to costs.
