Per: Dr. Lata Baswaraj Patne, Judicial Member.

The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-

“a)

Direct the respondents to consider and dispose of the applicant’s representation dated 09.06.2026 in accordance with the forwarding letter dated 06.04.2026 and Employer’s Certificate issued by the respondent no. 3.

b)

Direct the respondents to issue the necessary relieving order to enable the applicant to join the post of Senior Administrative Officer (SAO), Group-A on deputation at AIIMS, Bhopal.

c)

Production of records of the instant case.

d)

Any other or further order or orders as this Hon’ble Tribunal may deem fit and proper”.

Ld. Counsel for the applicant Mr. Bharat Bhushan and Mr. Tamal Mondal are present and heard.

Ld. Counsel for the applicant files the affidavit of service which is taken on record. However, none appears for the respondents.

When the matter was taken up for admission, Ld. Counsel for the applicant submitted that the applicant is working as a Deputy Director under the Khadi and Village Industries Commission (KVIC) and is presently posted at Gangtok, Sikkim.

Ld. Counsel for the applicant submitted that pursuant to the advertisement issued by AIIMS Bhopal for the post of Sr. Administrative Officer (SAO) on deputation, the applicant had applied through proper channel and after completion of selection process, AIIMS Bhopal had issued an Offer of Appointment to the applicant on 08.06.2026.

Ld. Counsel for the applicant further submitted that despite several representations, reminders and communications addressed to the competent authorities, including the Chief Executive Officer, KVIC and the Ministry of MSME, no decision was taken by the competent respondent authority regarding the applicant’s relieving and because of the respondents’ inaction, the applicant had to request AIIMS Bhopal for extension of joining time. He, therefore, prays that a direction is issued upon the respondents to consider his representation dated 09.06.2026 in a time-bound manner.

Considering the aforesaid submission made by Ld. Counsel for the applicant, and, without entering into the merits of the case, the competent respondent authority is directed to consider the pending representation dated 09.06.2026 and pass a reasoned and speaking order within a period of 03 months from the date of receipt of a copy of this order. However, law of limitation is kept open.

The Original Application is accordingly disposed of. There shall be no order as to costs.
