Heard Mr. Asim Pandya, learned senior counsel assisted by Mr. V.A. Vyas, learned counsel and Mr. P.M. Bhatt, learned counsel for the respective parties.
This application is filed by the Presiding Officer of the concerned Court against whom the Coordinate Bench of this Court vide order dated 13.01.2023 observed that, the petitioner have did not comply with the directions issued by this Court and therefore, the copy of this order be kept in his service book and matter be placed before the Chief Justice for necessary action. The petitioner made a representation on 09.03.2023. This Court on its administrative side, took a decision not to take any action as proposed and by confidential letter dated 22.02.2023, the same was conveyed to the petitioner.
In the aforementioned background facts, the learned senior counsel submitted that, the impugned order, more particularly the observations and directions made in para-4 of the order be recalled as if it is not recalled, then, it will permanently become a part of the record and the same would be stigmatic to the petitioner.
Having heard learned counsel appearing for the respective parties and considering the subsequent development as discussed hereinabove, case is made out to recall the observations and directions made in para-4 of the order dated 13.01.2023.
Accordingly, present application is allowed. The observations and directions made in para-4 of the order dated 13.01.2023 is hereby recalled.
