Learned Counsel for the Operational Creditor brought to our notice that the Corporate Insolvency Resolution Process has already initiated against the same Corporate Debtor i.e. Pradip Overseas Ltd. vide its order dated 09.11.2020 in CP(IB) No. 221/7/NCLT/AHM/2017. In view of this, the present IB Petition stands disposed of being infructuous.

The Operational Creditor is at liberty to approach IRP/Resolution Professional to lodge its claim and Resolution Professional to consider the same as per the Rules. Further, the liberty is granted to revive this proceeding in case Corporate Insolvency Resolution Process of the Corporate Debtor is set aside.

Accordingly, CP(IB) No. 287 of 2020 stands disposed of being infructuous.
