Judgment

Heard the parties.
Petitioners are apprehending their arrest in connection with Complaint Case No. 1770/2019 for the offences registered under sections 33 and 33 (i) (c) of Indian Forest Act, pending in the court of Ms. Mansi, learned Judicial Magistrate, 1st Class, Giridih.
Petitioners are said to have encroached about 3.5 acres of Motileda protected forest area.
Supplementary affidavit has been filed bringing on record the fact that the petitioners are owners of the land and they are paying rent with regard to the said land.
Considering the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, petitioners, above named, are directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on their surrender, shall release them on bail on furnishing bail bonds of Rs. 25,000/-(Rupees twenty five thousand) each, with two sureties of the like amount each, to the satisfaction of Ms. Mansi, learned Judicial Magistrate, 1st Class, Giridih in connection with Complaint Case No. 1770/2019, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
