Jaya Roy, J.—Heard learned Counsel for the Petitioners and learned Counsel for the State.

Petitioners are apprehending their arrest in connection with the case registered under Sections 33 and 63(C) of the Indian Forest Act.

Learned Counsel for the Petitioners submits that they have not committed any offence. The police has falsely implicated them in this case only on the basis of previous enmity.

Mr. Shekhar Sinha, learned Counsel for the State, has submitted that the Petitioners tried to encroach the forest land, after cleaning bushes and for that state has incurred loss of Rs. Four thousand.

Considering the facts and circumstances of the case, the Petitioners are directed to deposit a sum of Rs. 2,000/- (Two thousand) each in the trial Court as a condition for granting anticipatory bail and surrender in the court below within a period of one month from the date of this order and after deposit of the aforesaid amount and his surrender within the said period the trial Court is directed to release them on bail, on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of like amount each to the satisfaction of Judicial Magistrate, 1st Class, Latehar in connection with C.F. Case No. 67 of 2010 corresponding to Offence Report No. 716 dated 06.05.2010, subject to the condition that one of the bailors will be their close relative and other will be of local resident having immovable property within the jurisdiction of the trial court and also subject to the condition laid down u/s 438(2) of the Code of Criminal Procedure
