Judgment
S.R. Brahmbhatt, J
On 24.01.2018, the Court passed the following order:
"We have perused the reply affidavit filed by the Geologist, Surat. Thereafter, after filing the above affidavit, there is no affidavit filed on behalf of any of the respondents. Though the petition is of the year 2016, there is no affidavit filed till date on the allegations made by the appellant. Learned Assistant Government Pleader seeks time to file appropriate affidavit by next date of hearing. Stand over to 31.1.2018."
Learned counsel for the petitioner submitted that till date, no affidavit is filed apropos that order. Learned advocate for the petitioner made serious grievance with regard to the omission on the part of the State.
Learned AGP at this stage submitted that there is no escape to the criticism, which would warrant on account of omission on the part of State. However, he seeks time and assures the Court that by next date of hearing, appropriate compliance by way of affidavit be reported.
At his request, matters are adjourned to 05.09.2109.
