Judgment
ORDER
This Criminal Petition has been filed seeking to quash the proceedings in F.I.R. No.501 of 2026 on the file of Neredmet Police Station, Malkajgiri District, wherein the petitioner was arrayed as accused for the offence punishable under Section 78 of the Bharatiya Nyaya Sanhita, 2023.
Heard Mr.Burgula John Dinakar, learned counsel for the petitioner and Mr.Jithendar Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1.
During the course of hearing, the learned Additional Public Prosecutor, basing upon the written instructions furnished by the Sub-Inspector of Police, Neredmet Police Station, Malkajgiri Commissionerate, submits that even prior to filing of the present criminal petition, the Investigating Officer after conducting investigation filed the final report before the learned XX Metropolitan Magistrate, Malkajgiri on 03.07.2026, and the C.C. number is awaited.
Taking into consideration the submissions made by the learned Additional Public Prosecutor, the learned XX Metropolitan Magistrate, Malkajgiri, is directed to take appropriate steps pursuant to the final report submitted by the Investigating Officer on 03.07.2026. In the event the learned Magistrate takes cognizance against the petitioner in F.I.R. No.501 of 2026, the petitioner is granted liberty to avail the remedies as available under law by raising all the grounds which are pleaded in the present Criminal Petition.
Accordingly, the Criminal Petition is disposed of.
Pending miscellaneous applications, if any, shall stand closed.
