Judgment
Ld. AROC submits that they are awaiting the report from ROC, Mumbai since Avan Projects Pvt. Ltd. a Logistic Pvt. Ltd. is a related party of the Corporate Debtor. It has become necessary to look into this before the resolution plan can either be approved or rejected. Learned AROC present in Court is directed to impress upon the ROC Mumbai, the importance of this Report which is required urgently in this case. A court notice be also issued in addition to ensure that reply is received post haste. To come up on 19th August, 2019 failing which they shall be liable for contempt proceedings.
It is pointed out by learned RP that no objection has been received by Awan Logistic Technology Pvt. Ltd. from Avan Motors Pvt. Ltd. which is the promotor company of Avan Logistic Pvt. Ltd. annexed as Annexure 1 in report filed by the RP on page 18 certifying that they have no objection to the word Avan being used by the proposed company. Be that is it may, this has to be re- confirmed by the ROC Mumbai that these are not related parties. To come up on 19th August, 2019.
