Judgment
ORDER
IA 1221/2020 has been filed praying for directions for liquidating the assets of the Corporate Debtor. Vide the said application, it is prayed that in view of the resolution passed by the COC, duly approved by 72.04% in terms of the voting share, it has been resolved that assets of the Corporate Debtor be liquidated.
It would not be out of place to mention that the resolution plan was rejected by this Bench with directions to proceed towards liquidation vide order dated 3rd January 2020. The consent of the RP to continue as the Liquidator has been filed along with this application. In view of the same, this Bench hereby appoints Mr. Hari Babu as the Liquidator. He may take steps as are required under liquidation proceedings and file his periodic report from time-to-time.
Vide a separate order, CA 571/2018 stands disposed off, allowing the prayer of the RP for setting aside the claim of the related party/non-applicant no. 4 as being preferential and fraudulent.
