Judgment
When the instant CP filed under Section 9 of the Insolvency and Bankruptcy Code, 2016 (for short, the Code) for initiation of CIRP against ADI Automotives Pvt. Ltd. & Anr was taken up for hearing, Mr. Vaibhav Sahni, proxy counsel appearing for the petitioner-company submitted that against the very same respondent/corporate debtor, CP (IB) No. 259/Chd/Hry/2019 filed by one of the operational creditor – M/s. S K Uni Print Private Limited has been admitted by this Adjudicating Authority on 08.01.2020. By the same order dated 08.01.2020, moratorium was declared and Interim Resolution Professional was also appointed.
In view of the above, the instant CP is disposed of as no other order is necessary, with a liberty that the petitioner may prefer their claim to the Interim Resolution Professional/Resolution Professional in accordance with the provisions of the Code and the Regulations framed thereunder.
