Judgment
Heard Ld. Counsel for the applicant and Ex-Resolution Professional who has resigned for certain personal reasons which has been approved by the COC. It is observed that Mr Manish Santosh Buchasia has in the 4th COC after the Resolution Plans have been finalised for seeking the approval of COC. The sole COC member has recommended the name of Mr Amrish N Gandhi as the new Resolution Professional Registration No.: IBBI/ IPA-002/ IP-N00670/ 2018-2019/ 72036' had duly given a written consent under Form - AA to act as the Resolution Professional of M/s. Dharti Proteins Limited i e" the Corporate Debtor".
We observe that the Ex RP has already taken extension of the CIRP process and no further extensions would be granted in the matter. We appoint the new RP Mr Amrish N Gandhi as the new Resolution Professional with directions to the Ex RP to hand over all the necessary documents processed during the CIRP to Amrish N Gandhi within 7 days of this order and had over necessary charge. We observe that the new RP appointed is in the IBBI updated list. He is directed to file a compliance affidavit by separate IA and update the process of CIRP after placing the same before the COC including substitution of his name in any IAs pending in the matter before this Tribunal.
This application with above directions is allowed and disposed of.
