Judgment
PER HON’BLE MR. PANKAJ KUMAR, MEMBER (A)
In this case relating to payment of retirement dues, the applicants have sought the following reliefs:
a)An order or direction directing the respondents for making payment of gratuity, leave encashment, provident fund, amount of insurance and other retiral dues in favour of petitioner No. 1 and the amount of family pension in favour of petitioner no. 2 & 3 due to be paid to the defendants of Late Murli Manohar.
b)Any other order or direction which this Hon'ble Court may deem just fit and proper may also be passed, along with cost.
Heard the learned counsel for the applicants, learned counsel for the respondents and perused the records.
Learned counsel for the applicants submits that the instant O.A. may be disposed of as applicants are only seeking decision on the representation preferred by them and ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representation of the applicant no. 1 dated 11.03.2025 attached as Annexure No. A-1 (pages 19 to 21) of this OA, by way of reasoned and speaking order within a stipulated period of time.
Learned counsel for the respondents opposes the aforesaid prayer; however, submits that, if so directed, at least three months’ time may be given for disposal of applicants’ representation in the said manner.
Keeping in view the innocuous prayer made by the applicants, this O.A. is disposed of, without going into the merits of the case, with a direction to the respondents/competent authority to consider and decide the pending representation of the applicant no. 1 dated 11.03.2025 attached as Annexure No. A-1 (page 19 to 21) of this OA, by way of reasoned and speaking order to be communicated to the applicants within three months from the date of receipt of certified copy of this order.
Associated MAs also stand disposed of.
Parties shall bear their own costs.
