This matter has been taken up by me through Video Conferencing on being mentioned by the learned counsel for the applicant in view of urgeni y that the Receiver is going to take over the property in question on 27.03.2023.
Misc. Application No.148/2023
This application has been filed by the applicant seeking direction to i he Ld. DRT-II, Delhi to take up their S.A. No.132/2023 and I.A for inter relief and decide the same at the earliest.
The learned counsel for the applicant states that the Receiver appointed by the learned CMM has issued a notice for taking over the possession of the property in question at 12.00 noon on 27.03.2023. Learned counsel further states that aggrieved by the same, the applicant has filed the aforesaid S.A. before Ld. DRT-II, Delhi and the is pending. Learned counsel for the applicant submits that since the learned DRT-II, Delhi has no regular Presiding Officer and its additional charge has been given to the learned Presiding Officer, DRT-III, Delhi, his matter is not being taken up by Ld. PO, DRT-III, Delhi for hearing. Learned counsel for the applicant states that the next date fixed in the matter before the learned DRT is 04.05.2023. In these circumstances, the learned counsel for applicant states that the learned Presiding Officer, DRT-III, Delhi, who is holding additional charge of DRT-II, Delhi, may be directed to take up the applicant's S.A. No.132/2023 and the I.A. for interim relief and decide same at the earliest.
Heard. The learned Presiding Officer, DRT-III, Delhi, who is I. aiding additional charge of learned DRT-II, Delhi, is requested to take up the appl cant's S.A. No.132/2023 and I.A. for interim relief at 11 a.m. on 27.03.2023 anc pass appropriate orders in accordance with law.
With the above direction, the application stands disposed of.
