Judgment
This Writ Petition is filed to declare the action of respondent Nos.1 to 3 in highhandedly putting up a sign board over the private residential house property of the petitioner bearing H.No.15-5-364, Osman Shahi, Gowliguda, Hyderabad, admeasuring 60.22 sq.yards, without following the procedure of law and without notifying the petitioner and to direct the respondents forthwith to remove the sign boards and not to interfere with the possession and enjoyment of the subjection property of the petitioner.
With the consent of both the parties, the writ petition is being taken up for disposal. Perused the entire record.
Heard Mr. Vedula Venkat Ramana, learned Senior Counsel representing M/s. Bharadwaj Associates, for the petitioner and Mr. Farhan Azam Khan, learned Standing Counsel for the Waqf Board.
Earlier, the petitioner approached this Court in W.P.No.24983 of 2026 and this Court passed the following order:
"List on 05.08.2026, immediately after 'Motion List'. Meanwhile, if the respondents intend to initiate any action in respect of the subject property, they shall strictly follow the due process of law."
Learned Senior Counsel appearing for the petitioner in support of petitioner's title and possession on the subject property would submit that the petitioner has purchased the subject land to an extent of 60.22 sq.yards, by way of the registered sale deed, dated 08.06.2023. Learned Senior Counsel has drawn the attention of this Court to the statement of encumbrance on property issued by the Registration and Stamps Department and also filed a copy of electricity bill and property tax dues of the said property. He further submits that H.No.15-5-364 has been allotted by the GHMC in the name of the petitioner.
Learned Senior Counsel further submits that a caution board has been fixed in the property of the petitioner without any information or notice and there is no mention about the survey number or extent on the caution board and the caution board itself is vague and not in accordance with law.
Learned Standing Counsel for the Waqf Board would submit that the respondent authorities have already initiated action on the subject property and fairly submits that the caution board does not contain any details/information. He submits that the respondents will follow the due process of law before initiating any action on the property of the petitioner.
Heard and perused the record.
Recording the submission of the learned counsel on either side, this Writ Petition is disposed of directing the respondents to remove the caution board from the petitioner's subject property. The respondent authorities shall follow due process of law before initiating any action on the subject property of the petitioner and if the authorities propose to initiate any action on the subject property shall issue notice to the petitioner and afford him an opportunity of hearing and thereafter pass appropriate orders.
With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any, pending in this writ petition, shall stand closed.
