ORDER
Learned counsel for both sides present.
This matter is coming up today for reporting compliance of statutory deposit. When the matter is taken up, learned counsel for the petitioner submitted that the petitioner wants to withdraw this appeal.
This Tribunal passed an order on 28.01.2026 in the waiver application in IA 24/2026 directing the petitioner to make pre-deposit of 30% of Rs.5,09,43,917/- i.e. Rs.1,52,83,175/- in two equal instalments within a period of four weeks from 28.01.2026 and the said period had expired on 25.02.2026 and that the matter was posted to today for reporting compliance.
When the matter is taken up today, it is reported by the Office as well as by the Ld. Counsel for the parties that pre-deposit, as ordered by this Tribunal on 28.01.2026 is not complied with.
Under the circumstances, this application IA 24/2026 (Waiver) is dismissed for non-compliance of statutory deposit, resulting in rejection of Appeal in AIR (SA) 2714/2025 by giving effect to conditional order dated 28.01.2026.
