This writ petition for mandamus is filed to declare the inaction of respondents 3 and 4 in not taking steps to provide police protection pursuant to the letter dated 21-6-2022 addressed by the Chief Executive Officer, A.P. State Wakf Board, Vijayawada, on the occasion of annual Urs celebrations scheduled to be held from 06-10-2022 to 08-10-2022 as illegal and consequently sought direction to respondent No.3 to provide police protection to the petitioner-institution to celebrate the Urs festival from 06-10-2022 to 08-10-2022.
Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home appearing for respondents 1 to 3, and learned Government Pleader for Revenue appearing for respondent No.4.
The petitioner is a wakf institution. The celebrations of Urs festival as per the custom in vogue is scheduled to be held from 06-10-2022 to 08-10-2022 in Siddavatam Village of Kadapa District. The Chief Executive Officer of A.P. State Wakf Board, Vijayawada, has addressed a letter to the Tahsildar, Siddavatam Mandal, Kadapa District and to the Station House Officer of Siddavatam Police Station, Kadapa District, requesting them to provide police protection to maintain peace and tranquility at the religious institution at the time of celebration of annual Urs celebrations scheduled to be held from 06-10-2022 to 08-10-2022.
The grievance of the writ petitioner is that the respondents-police officials are not taking into consideration the said letter addressed by the Chief Executive Officer of A.P. State Wakf Board and they are not providing said police protection to enable the petitioner to peacefully celebrate the annual Urs celebrations from 06-10-2022 to 08-10-2022.
Learned Assistant Government Pleader for Home would submit that if the Court passes appropriate order to provide police protection that the police would provide the same.
Therefore, the writ petition is disposed of with a direction to the respondents-police officials to provide adequate police protection to the petitioner to peacefully celebrate the annual Urs celebrations from 06-10-2022 to 08-10-2022 in Siddavatam Village of Kadapa District. Pending applications, if any, shall stand closed. No costs.
