Heard Mr. Somavarapu Satyanarayana, learned counsel for the petitioners, Mr. Putta Krishna Reddy, learned standing counsel for respondent Nos.2 to 4 and Mr. V.V. Rama Krishna, learned counsel for respondent Nos.5 and 6.

Learned counsel for respondent Nos.5 and 6 requests time to file counter and the same is opposed by learned counsel for the petitioners.

Learned counsel for the petitioners submitted that final order (demolition order) has been passed under Sections 178(6) of the Telangana Municipalities Act 2019 vide Notice No.26/2/2024/TPS/NLG dated 29.08.2024 directing respondent Nos.5 and 6 to remove unauthorized construction of cellar floor on the subject property within a period of fifteen (15) days from the date of receipt of order.

Learned standing counsel for respondent Nos.2 to 4 submitted that copy of final order dated 29.08.2024 has been forwarded to the District Task Force, Nalgonda, for implementation of order and the same will be implemented in due course of time.

Learned counsel for respondent Nos.5 and 6 submitted that final order dated 29.08.2024 has been passed without conducting appropriate enquiry and without issuing any notice. Respondent Nos.5 and 6 have submitted reply dated 17.09.2024 to impugned final order and respondent No.2 may be directed to consider the same before implementing final order.

In view of the above, without going into merits of the case, the writ petition is disposed of, directing respondent No.2 to consider the reply dated 17.09.2024 submitted by respondent Nos.5 and 6 to the final order vide Notice No.26/2/2024/TPS/NLG dated 29.08.2024, and pass orders, in accordance with law, by affording opportunity of hearing to the petitioners, respondent Nos.5 and 6 and all other concerned/interested persons, within a period of four (4) weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
