Judgment

This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A-2, seeking regular bail, in Crime No.119 of 2023 of Amalapuram Town Police Station, Dr.B.R.Ambedkar Konaseema District.
The case of the prosecution is that on 05.03.2023, A1 to A7 were carrying Ganja of 21 Kgs and they were apprehended while it was being transported. It was noticed that each individual accused was carrying different quantities of Ganja in the School Bags. In so far as, the petitioner/A-2 is concerned, he was found in possession of 4 Kgs of Ganja. Accordingly a case has been registered against the petitioner herein and others for the offences punishable under Sections 8(c) read with 27(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). The petitioner/A-2 was arrested and sent to judicial custody on 06.03.2023.
Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent.
The learned counsel for the petitioner submits that A-3 was already enlarged on bail by this Court dated 02.05.2023, vide Crl.P.No. 2999 of 2023 and for the last 87 days, the petitioner has been languishing in jail.
On the other hand, the learned Assistant Public Prosecutor submits that though, the total quantity of Ganja is 21 Kgs, each accused was found in different quantities of Ganja from their possession.
In view of the above said facts and circumstances, the petitioner is enlarged on bail, subject to the condition that he furnishes two sureties for a like sum of Rs. 10,000/- each to the satisfaction of the learned Additional Judicial Magistrate of I Class, Amalapuram. On release, the petitioner shall appear before the concerned Station House Officer once in a week i.e., on every Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
Accordingly, the Criminal Petition is disposed of.
