This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A-2, seeking regular bail, in connection with the Crime No.207 of 2022 of Martur Police Station, Bapatla District, for the offences punishable under Sections 20(b)(ii)(c) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

The case of the prosecution is that the petitioner along with the other accused indulged in transportation of 140 Kgs of Ganja and the same was seized by the Police, while A1 to A3 were travelling in the car bearing AP 05 CK 1929.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent.

The learned counsel for the petitioner submits that in this case investigation was completed and A-1, A-3 to A-5 were enlarged on bail and as such, the petitioner being the A-2 may be considered for grant of regular bail. The petitioner has been languishing in jail since 13.10.2022.

On the other hand, the learned Assistant Public Prosecutor for the respondent submits that Charge Sheet is also filed in S.C.No.3 of 2023 on the file of the Court of the I Additional District and Sessions Judge, Prakasam District at Ongole and the other accused were also enlarged on bail in the above said crime.

In reply also, the learned counsel for the petitioner submits that A-5 was also enlarged on bail, as per the orders of this Court dated 11.05.2023 in Crl.P.No. 3393 of 2023.

In view of the above said facts and circumstances, the petitioner is enlarged on bail, subject to the condition that, he shall furnish two sureties for a like sum of Rs. 20,000/- each to the satisfaction of the learned I Additional District and Sessions Judge, Prakasam District at Ongole. On release, the petitioner shall appear before the concerned Station House Officer once in a week i.e., on every Friday between 10.00 a.m. and 01.00 p.m., till the trial is commenced and the petitioner shall not violate any of the conditions of this bail.

Accordingly, the Criminal Petition is disposed of.
