(Per:- Pragya Sahay Saksena, Administrative Member)

Learned counsel for the applicant submitted that despite availability of six vacancies of Deputy Director in Pay Level-12, the applicant who figures at serial No.4 in the seniority list of Geologist Grade-I as it stood on 01.01.2025, has not been considered for his promotion and in this regard, he has filed representation on 12.05.2026, but the same has not been decided till date.

2.

It is further submitted by learned counsel for the applicant that the applicant will suffer prejudice as he is going to retire in the month of December 2026.

3.

Learned counsel further submitted that the applicant would be satisfied, at this stage, if this O.A. is disposed of with direction to respondents to treat a copy of this O.A. as representation of the applicant and decide the same within a time frame.

4.

Mr. Rajesh Thapa, learned A.A.G. appearing on behalf of respondents, on advance notice, seeks sometime to file reply.

5.

Having heard the learned counsels for the parties, we are of the considered view that no useful purpose would be served in keeping this O.A. pending and same can be disposed of with directions to respondents.

6.

Accordingly, this O.A. is disposed of, at the admission stage itself, without entering into the merits of the case, with a direction to respondents to treat a copy of this O.A. as representation of the applicant and decide the same along with representation dated 12.05.2026 filed earlier by the applicant, by passing a reasoned and speaking order, within a period of four weeks from the date of receipt of a certified copy of this order. A copy of the speaking order shall also be communicated to the applicant.

7.

There shall be no orders so as to costs.
