Judgment
In this application direction is sought to ensure that passage for inlet of rain water is left free on the flanks of roads inter alia by preventing dumping of building material over the flanks of roads to avoid blockage of rain water drainage and water logging during rainy season.
While the issue raised is important for consideration of the statutory regulators, particularly the development authorities, this may require policy, programs, planning, implementation and close monitoring by the administrative authorities. On such issues, role of Tribunal can only be to forward the suggestions to the concerned executive authorities.
Accordingly, let Ministry of Urban Development, GoI, Central Ground Water Authority, Additional Chief Secretaries/Principal Secretaries, Urban Development Departments, Public Works Departments and Panchayat Raj Departments of all the States/UTs may consider and take appropriate action in the matter.
The application is disposed of.
A copy of this order be forwarded to Ministry of Urban Development, GoI, Central Ground Water Authority, ACS/PS, Urban Development Departments, Public Works Departments and Panchayat Raj Departments of all the States/UTs by e-mail for compliance.
