Judgment
Grievance in this application is against inaction of authorities in cleaning drain in Gauri Kunj and on the service lane of the National highway-3, Agra, UP.
Case of the applicant is that NHAI has constructed a road from Rohta to Nagla Makraul, Itora at Agra which is a stretch of more than 12 km with service lane on both sides. On both sides of the said Highway, thousands of people reside in approved and unapproved residential colonies. Plots have been allotted by private colonisers. There are numbers of agricultural lands and markets on this 12 km stretch. The applicant and other inhabitants of the area are facing problem of drainage congestion leading to water logging and flooding. The affected stretch has witnessed almost knee-deep water logging. Rainwater mixes with sewer water and spreads foul odour. This creates unsanitary conditions with potential health risk for residents. Agra Development Authority (ADA) has to construct a drainage network system for the area and NHAI has to develop a drain (nalla) along the side of the National highway from Rohta to Kakua. Water accumulation is causing-water-borne diseases. Despite regular complaints, the Agra development Authority (ADA) and NHAI have done nothing to solve the problem. This is degrading the environment calling for intervention of this Tribunal under section 15 of the NGT Act, 2010.
The applicant has annexed photographs of the area in support of his averments and also copy of letter dated 31.03.2023 addressed to the Chairman, NHAI.
We are of the opinion that grievance needs to be looked into and remedial action in accordance with law by a joint Committee of Agra Development Authority, UP State PCB and District Magistrate, Agra.
The application is disposed of accordingly.
A copy of this order be forwarded to Agra Development Authority, UP State PCB and District Magistrate, Agra.
The applicant may serve a set of papers on Agra Development Authority, UP State PCB and District Magistrate, Agra and pursue the matter further with the above authorities.
