Heard Ms. Payal Bahl, learned counsel for the applicant.

In the present application, the applicant has challenged the order dated 15.01.2019 (stated to have wrongly been typed in place of 15.01.2020) by which the Inquiry Officer has rejected the request of the applicant for providing the additional documents. The applicant is further stated to be aggrieved on account of the action of the respondents in not deferring the ongoing disciplinary proceedings in spite of the fact that the applicant has suffered from COVID- 2019.

The Learned counsel for the applicant submits that the applicant is ready to raise his grievances before the Competent Authority in accordance with the relevant rules for remedial action.

Ms. Esha Mazumdar, learned standing counsel, appears on behalf of the respondents. She submits that the last date fixed in the ongoing enquiry proceedings was 12.03.2020 and thereafter, though the applicant was summoned for appearance in the enquiry but due to Lockdown, no proceeding took place and no further date was given. She further submits that if the applicant prefers any representation in the matter, the respondents shall consider the same in accordance with the relevant rules and instructions on the subject.

In view of the aforesaid, the learned counsel for the applicant seeks permission to withdraw the OA with liberty in accordance with relevant rules and instructions on the subject.

In view of the aforesaid, the present OA stands dismissed as withdrawn with liberty in accordance with relevant rules and instructions on the subject. No costs.
