Judgment
O R D E R
By Hon’ble Mr. Justice Om Prakash VII, Member (Judicial) Shri S.K. Kushwaha, learned counsel for the applicant and Shri L.S. Kushwaha holding brief of Shri D.P. Singh and Shri Chakrapani Vatsyayan, learned counsel for the respondents are present.
Heard on Withdrawal Application No. 3421 of 2024.
The submission of learned counsel for the applicant is that the OA was filed against the charge sheet issued against the applicant. No interim relief was granted to the applicant. Inquiry was conducted and punishment has been imposed. Thus, referring to the withdrawal application, argued that the applicant be permitted to withdraw this OA with liberty to file a fresh OA.
Shri L.S. Kushwaha holding brief of Shri D.P. Singh, learned counsel appearing for contesting party did not oppose the prayer of the applicant.
We have considered the rival submission of the parties and perused the record.
The prayer made by learned counsel for the applicant in MA No.3421 of 2024 is allowed. The applicant is permitted to withdraw this OA with liberty to file a fresh OA subject to limitation period. The OA is dismissed as withdrawn.
No order as to costs.
