Judgment
I.A. No.4 of 2026 is filed seeking to relax/modify Condition No.(ii) imposed by this Court in the order dated 04.06.2026 passed in I.A. No.1 of 2026 in W.P. No.17113 of 2026, by permitting the petitioner to appear before the Investigating Officer once in a fortnight instead of every Monday, Wednesday, and Saturday.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents No.1 to 3.
Learned counsel for the petitioner, however, submits that the petitioner is ready and willing to appear before the police as and when necessary, upon being given at least one day's notice, even through WhatsApp or text message.
Learned Assistant Government Pleader for Home, however, objected to the same and submitted that the petitioner should appear before the Police every fortnight.
Learned counsel for the petitioner, however, submits that 11 cases have been filed in respect of the very same transaction and that, in two of the said cases, charge sheets have been filed and proceedings pursuant to the said charge sheets have been stayed by the Court. Copies of the said orders have also been filed.
In view of the above facts and circumstances and since the petitioner is willing to appear before the police as and when required upon receiving one day's notice, Condition No.2 in paragraph No.38 is modified to the following extent:
"The petitioner shall appear before the Investigating Officer as and when called upon to do so, upon one day's prior notice, and shall cooperate with the investigation and make himself available for interrogation as and when required."
In view of the above, I.A. No. 4 of 2026 is accordingly allowed.
The writ petition is accordingly disposed of. No order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
