Judgment

The applicant took part in the Civil Services Examination-2019. He claimed the status of Economic Weaker Section (EWS) candidate. Litigation
ensured in this behalf and OA No.938/2020 was filed. The OA was allowed with certain directions and that facilitated the participation of the
applicant in the examination, at various stages. The order passed by the Tribunal was also upheld by the Hon’ble High Court, and at present, an
SLP is said to be pending. The applicant contends that despite specific directions in the OA, the respondents did not indicate the marks secured by
him, and on that account, his career is at stake.
This OA is filed with a prayer to direct the respondents to disclose the marks obtained by the applicant in the CSE-2019.
The OA was adjourned on several occasions. An order was passed directing the respondents to declare the marks, subject to the outcome of the
SLP. It is rather gratifying to note that though with some delay, the UPSC has declared the marks of the applicant and other similarly situated EWS
candidates. It hardly needs any mention that further steps need to be taken in accordance with law.
We, therefore, close the OA taking note of the fact that the marks of the applicant are communicated to him. We also place on record the efforts
made by Shri Naresh Kaushik and Shri R. V. Sinha, learned standing counsel for the UPSC for the initiative, they have taken.
