Judgment

The applicant took part in the Civil Service Examination (CSE), 2019. He claimed reservation under the EWS category. The UPSC, however, did not recognize his status. Thereafter, he filed this OA with a prayer to direct the respondents to process his candidature under the EWS category.
We heard Sh. Dibyanshu Pandey, learned counsel for the applicant and Sh. R.V. Sinha, learned counsel for the respondents.
This very issue, in relation to the CSE, 2019, fell for consideration before this Tribunal in OA No. 3332/2019. In a detailed judgment dated 13.01.2020, it was directed that the UPSC shall extend the benefit of reservation of EWS category in case the candidates fit into the parameters, mentioned therein. It is brought to our notice that the judgment in the OA was upheld by the Hon'ble High Court. In case of the applicant also, we passed an interim order dated 29.07.2020 directing the respondents to apply the same parameters to him. That was at a time when the final decision was pending. The issue has since been decided finally.
We, therefore, dispose of the OA in terms of the judgement in OA No.3332/2019 and direct the respondents to consider the status of the applicant under the EWS category.
There shall be no order as to costs.
