Heard learned counsel for the appellant, learned APP for the State and learned Amicus Curiae for the victim.

The present appeal has been filed against the order dated 22.11.2024 passed by learned Additional Sessions Judge-I, Lohardaga cum Special Judge, Children Court, Lohardaga in Misc. Criminal Application No.439 of 2024 in connection with Lohardaga Mahila P.S. Case No.12 of 2022 (G.R. No. 310 of 2022), registered for the offence under Sections 376DB, 506, 341, 342, 363 of IPC and Section 6 of POCSO Act by which prayer for bail of the appellant has been rejected. The case is pending before the Court of learned Additional Sessions Judge-I, Lohardaga cum Special Judge, Children Court, Lohardaga.

The juvenile in conflict with law, is in custody since 02.05.2022, has approached this Court for release through his mother who is ready and willing to keep her child under her custody with proper care. The social investigation report and stage of trial have also been called for. From the stage of trial, it also appears that the prosecution evidence has already been closed.

Learned counsel for the respondents have opposed the prayer for bail.

Considering the nature of crime and social investigation report, I am not inclined to enlarge the appellant on bail. Accordingly, the present criminal appeal is hereby, rejected.

The assistance given by Mr. Shyam Sundar Pd. Kushwaha, learned Amicus Curiae is highly appreciable.

Let this order be communicated to the learned Member Secretary, JHALSA, Ranchi, for the purpose of remuneration to be paid to the learned Amicus Curiae as permissible.
