Judgment
Heard learned counsel for the appellant, learned APP for the State and learned counsel for the victim.
The present appeal has been filed against the order dated 10.12.2025 passed by learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No.941 of 2025 in connection with Netarhat P.S. Case No.08 of 2025(Juvenile Case No-12/2025 and Children Case No. 07 of 2025), registered for the offence under Section 96 and 137(2) of the BNS, 2023 and after investigation, the charge sheet has filed under Sections 103(1), 238 and 61 of B.N.S., 2023 by which prayer for bail of the appellant has been rejected. The case is pending before the Court of learned Additional Sessions Judge-I, Latehar.
The juvenile in conflict with law, is in custody since 11.03.2025, has approached this Court for release through her father who is ready and willing to keep his child under his custody with proper care. It appears that the juvenile is accused of committing murder. From the report submitted by learned Court below, it appears that out of 15 charge sheeted witnesses, 9 witnesses have already been examined.
On the other hand, learned counsel for the State and respondent No. 2 have opposed the prayer of the appellant.
Considering the social investigation report, the appellant is directed to be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with Netarhat P.S. Case No.08 of 2025(Juvenile Case No-12/2025 and Children Case No. 07 of 2025), subject to the condition that one of the bailors must be the father of the appellant.
Further, concerned Probation Officer is directed to report, once in three months, to the Children's Court, Latehar regarding the conduct of the juvenile. The Children’s Court is at liberty to take the juvenile in custody if her conduct is not found appropriate.
Accordingly, instant criminal appeal is allowed and disposed of.
