Heard learned counsel for the appellant and learned counsel for the respondent.

On behalf of Appellant it has been submitted that  a copy of the rejoinder has been served on the other side and it shall be filed during the course of the day.

Learned counsel has also indicated that rejoinder will be filed within the same time in an earlier appeal relating to the previous control period bearing AERA Appeal No. 1 of 2016. That will complete the pleadings in that matter also.

Learned counsel for the respondent suggests that both the appeals may be heard together because many issues are overlapping. Learned counsel for the appellant has no objection. He pleads for fixing this matter alongwith AERA Appeal No. 1 of 2016 for hearing at an early date because date of hearing has been fixed on earlier occasions in the Appeal of 2016 but the matter could not be taken up.

Let this appeal be tagged with AERA  Appeal No. 1 of 2016. Considering the above submissions, let both the appeals be listed "for hearing" on 8.12.2021 as first case subject to overnight part heard, if any.

Parties will be at liberty to file written notes of arguments in advance after exchanging copies with the other side.

Parties will be well advised to file convenience compilation so that hearing of the appeals is made convenient.
