The applicant seeks promotion to the post of Instructor, Civil Defence, Group ‘C’ post.

Learned counsel for the applicant submits that, despite the applicant being fully eligible for promotion, his candidature was not considered by the Departmental Promotion Committee (DPC) in its meeting held on 14.01.2026, on account of non-availability of vacancies in the Unreserved (UR) category.

Learned counsel further submits that, thereafter, the applicant has made several representations seeking consideration of the vacancies which are not being filled up due to non-availability of eligible candidates under the reserved categories. It is submitted that, despite the applicant being eligible, he is being denied consideration for promotion against such vacancies.

It is further submitted that the applicant submitted a detailed representation dated 29.01.2026, followed by reminders, but the same remains pending and unanswered till date.

At this stage, learned counsel for the applicant submits that the applicant would be satisfied if the respondents are directed to consider and decide the pending representation in accordance with the applicable rules/instructions.

Since the respondents are yet to consider and decide the representation, we do not deem it appropriate to enter into the merits of the claim of the applicant at this stage.

Accordingly, the Original Application is disposed of with a direction to the respondents to consider and decide the applicant’s pending representation dated 29.01.2026, along with the subsequent reminders, in accordance with the applicable rules/instructions, by passing a reasoned and speaking order, within a period of six weeks from the date of receipt of a copy of this order. The decision so taken shall be communicated to the applicant forthwith. No order as to costs.
