IA/6000/ND/2021, this application has been filed on behalf of the IRP under Section 12 of the Code and stated that the matter has already been settled with the Operational Creditor in the main petition in IB/839/ND/2019. The same has also been endorsed by the Ld. Counsel for the petitioner and stated that dues have been paid.
Taking into consideration the matter has been settled between the parties. The application stands allowed, IB/839/ND/2019 stands disposed of. In view of the settlement, CIR proceedings stand closed. Suspended Board of Directors shall take charge of the respondent/Corporate Debtor forthwith. IRP/RP stand discharged.
IA/653/ND/2022, is concerned, though the claim has been filed before the IRP. However, the matter has already been settled, so far as the IB/839/ND/2019 is concerned. Therefore, the applicant herein is IA/653/ND/2022 stand disposed of with liberty to avail the remedy and get the IB/570/ND/2019 to restored the as the same was ordered to be infructuous, because of reason, that the IB/839/ND/2019 was admitted and the CIR proceeding were ordered to be initiated. Therefore, to that extent the application stand disposed of.
IB/839/ND/2019 has been compromised so far as the IB/570/ND/2019 is concerned one applicant move an appropriate application for considering the original IB/570/ND/2019.
So far as IA/2394/ND/2022 & IA/1773/ND/2022 are concerned, are being disposed of with the direction to avail the remedy as per law. Accordingly, all the applications stand disposed-of.
