Judgment
ORDER
Ms. Prachi Johri, Ld. Counsel for the suspended management present. Mr. Rohan Agrawal, Ld. Counsel for the applicant present in IA-1952/2021.
IA 323/2022 and IA 255/2022: These applications have been filed by the Applicant for placing on record the order of Hon’ble NCLAT passed on dated 11.01.2022.
IA 500/2022: This application filed by one of the Operational Creditor aggrieved with the rejection of the claim by the RP.
IA 2574/2021: This is an application filed by the RP seeking direction of this Bench for payment of CIRP dues.
IA 1952/2021: This is an application filed by the IRP for placing on record section 12A application of the Operational Creditor and the Corporate Debtor submitting that the settlement has been agreed between the Operational Creditor and the suspended Board and requesting for withdrawal of the CIRP of the Corporate Debtor.
Since, the settlement has already been agreed between the Operational Creditor and the Corporate Debtor and as confirmed by the Counsel appearing for the RP that the entire CIRP cost has been paid to the RP by the suspended Board, nothing survives in this Petition bearing C.P. (IB)/3221(MB)2019. The Corporate Debtor is taken out from the rigours of CIRP. The Resolution Professional is directed to hand over all the charge of the Corporate Debtor to the Members of Suspended Board. The RP is also discharged from his duties of RP. All the IAs which are pending also disposed of.
The main CP along with all IAs are disposed of.
