Judgment
Ahanthem Bimol Singh, J
Heard Mr. H. S Paonam, learned senior counsel assisted by Ms. Harichhaya, learned counsel appearing for the petitioner.
Issue notice returnable within four weeks.
Mr. H. Debendra, learned GA accepts notice on behalf of all the respondents, hence, no formal notice is called for.
It is submitted at the Bar by both the learned counsel for the parties that there is another analogous petition being WP(C) No. 556 of 2022 pending before this Court and in that writ petition, this Court has passed an interim order dated 19-07-2022 thereby allowing the State authorities to proceed with the enquiry and at the same time directing that no coercive action should be taken against the petitioners pursuant to the impugned notice till the next date.
Both the learned counsel for the parties submitted that similar interim order can be passed in the present writ petition.
In view of the submission made by the learned counsel for the parties, it is hereby ordered that the State authorities can proceed with the enquiry connected with the impugned notification, however, it is made clear that no coercive action should be taken against the petitioners pursuant to the impugned notification till the next date and liberty is granted to the State authorities to approach this Court for modification/vacation of the interim order, if so advised.
List this case again on 22nd August, 2022.
Registry is directed to delete the name of Mr. A. Vashum, learned GA and in his place the name of Mr. H. Debendra, learned GA may be shown in the cause list.
